OGC is seeking an experienced attorney to serve as an Enforcement Attorney Advisor. Prior federal or state criminal prosecution experience is preferred, but not required. The individual will provide legal services and guidance to, inter alia, components of the USMS to ensure that law enforcement operations are conducted in compliance with constitutional and legal requirements, as well as U.S. Department of Justice (USDOJ) and USMS policy, and in a manner that promotes efficiency and public safety. The incumbent should have first-hand knowledge and specialized experience in applying and providing guidance on substantive criminal statutes, criminal case development, investigative methods and techniques, search and seizure, electronic surveillance, emerging investigative technologies, interview and interrogation, evidence, discovery, information-sharing restrictions, Federal sentencing guidelines, law enforcement operations and procedures (to include, e.g., multi-agency task force operations), legal training (to include development thereof), drafting and reviewing subpoenas, search warrants, court orders, motions and motion responses, and other pleadings relating to criminal and civil matters, drafting and reviewing legislative proposals and USDOJ policies relating to law enforcement, and legal review of USMS and USDOJ operational and other relevant policies and procedures. The incumbent will be required to represent the USMS at Department and interagency meetings and working groups, and in discussions with state and federal prosecutors, defense counsel, and the judiciary.

In addition, the attorney may be called upon to provide general legal advice to agency personnel, including agency leadership, and litigation support in agency-related cases to Assistant U.S. Attorneys and other U.S. Department of Justice counsel who represent the agency and its personnel in federal litigation. Enforcement Attorney Advisors in the Office of General Counsel, U.S. Marshals Service, also provide legal advice and assistance in other areas of law, including but not limited to, international and tribal law enforcement, prisoners, judicial and witness security, immigration enforcement, general criminal matters, and civil procedure.

  • Must be a U.S. Citizen or National.
  • Must successfully complete a background investigation to include credit and tax checks, and drug testing.
  • Selective Service registration is required, if applicable.
  • Must be able to obtain and maintain a Top Secret security clearance.
  • This position is a Testing Designated Position and is subject to random drug testing.
  • May be required to successfully complete a trial period

Qualifications

Applicants must possess a J.D. degree (or equivalent), be an active member of the bar in good standing (any U.S. jurisdiction) and have at least five (5) years post-J.D. relevant experience. Applicants must also have 1) the above noted specialized experience in criminal law, investigations, operations, and/or prosecutions; 2) excellent academic credentials; 3) strong oral and written communication and advocacy skills; 4) superior legal research and analytical skills; 5) experience in dealing with complex legal and policy issues; and 6) ability to formulate and implement USDOJ and USMS policies on all matters pertaining to assigned areas.

Proficiency in computer-aided legal research and computer word processing is required.
