Job Responsibilities

The South Carolina Attorney General's Office is seeking a versatile Criminal and/or Civil Prosecutor to join our Vulnerable Adult and Medicaid Provider Fraud Unit (VAMPF). Highlights of this unique opportunity include:

  • True Team Collaboration: Specialized VAMPF sworn law-enforcement investigators and auditors are physically located in the same office space. You will have daily in-person interactions with team members on your assigned cases, as well as opportunities to attend specialized training alongside task force members from SC and other states.
  • Dual-Track Professional Growth: You will lead criminal litigations while simultaneously participating in the expansion of the Unit's civil practice.
  • Hybrid Case Consultant and Prosecutor Role: Your case assignments will include a mix of those in active litigation and those under investigation, for which you will serve as a legal resource. About VAMPF

VAMPF investigates and prosecutes healthcare provider fraud and residential patient abuse across the state. We operate as a self-contained strike force, blending the agility of a small, specialized private firm with the impact of a state law enforcement agency. The role offers a unique opportunity to work cases from the receipt of a referral through conviction or judgment. While this is primarily a criminal litigation position, it also includes routine opportunities for legal and policy drafting and review, as well as civil case assignments.

Key Opportunities:

  • Litigate in state criminal and civil courts
  • Participate in federal cases, with potential to become admitted to the SC District, and apply for SAUSA designation
  • Proactively promote fraud deterrence and detection by providing case-based policy recommendations to the South Carolina Department of Health and Human Services and statutory revisions to the SC Legislature
  • Work directly on a team with VAMPF law enforcement and auditors throughout investigations
  • Manage a focused caseload limited to matters within the Unit's defined jurisdiction
  • Attend a six-week internal training program as well as specialized training offered by the National Association of Medicaid Fraud Control Units (NAMFCU) nationwide
  • Collaborate with numerous state agencies (Department of Public Health, Department of Social Services, Department on Aging, Department of Labor, Licensing and Regulation, Department of Behavioral Health and Intellectual Disabilities) and federal partners (HHS OIG, FBI, DCIS, VA, DOJ)

Primary Duties and Responsibilities

Under limited supervision, the attorney will:

  • Review and provide feedback on investigative plans
  • Evaluate evidence and assist investigators in identifying potential charges while advising on additional information needed
  • Review cases and provide input prior to charging, filing, or closure decisions
  • Make independent determinations on the merits of each case and present recommendations to Unit management
  • Serve as prosecuting attorney on assigned cases (with supervisory guidance), including drafting indictments, motions, legal memoranda, and other documents; Prepare and respond to discovery requests and motions; handling court presentations and trials; and respond to data requests and post-conviction/FOIA inquiries
  • Represent South Carolina in complex civil litigations, often in conjunction with other states and/or federal partners
  • Prepare cases for trial and/or civil litigation and make court appearances on behalf of the State of South Carolina
  • Comply with all grant documentation and reporting requirements
  • Perform additional duties as assigned by the supervisor, Chief Deputy, or Attorney General

Minimum and Additional Requirements

Juris Doctor (JD) degree and at least five (5) years of practicing experience.

Necessary Requirements: Member in good standing with the South Carolina Bar. Must satisfy Rule 403 requirements

Additional Requirements:

  • Ability to travel statewide to litigate and prosecute assigned cases

Preferred Qualifications

  • Criminal prosecution or defense experience (two years in a Solicitor's Office or Public Defender's Office strongly preferred)

  • Civil court and litigation experience (two years' experience strongly preferred)

  • Healthcare and/or white-collar crime experience

  • Proficiency with Microsoft Excel

  • Willingness to become familiar with:

  • Medicaid policies governing services, billing, and enrollment

  • Related licensing regulations

  • Omnibus Adult Protection Act and other applicable state laws

  • Regulations for nursing homes and assisted living facilities

  • Elder and estate law, specifically including the legal requirements for Powers of Attorney, Representative Payee, and fiduciary relationships

  • Standards of care for vulnerable adults

  • Cover letter strongly preferred
