The Associate Attorney will independently manage a diverse caseload of complex litigation matters, including contested foreclosures, evictions, bankruptcy adversaries, title disputes, lender liability claims, quiet title actions, wrongful foreclosure defenses, and appellate work. The position requires a hands-on approach to all phases of litigation—from initial case assessment and strategy development to motion practice, court appearances, settlement negotiations, and trial preparation.

This is a client-facing role that demands strong advocacy skills, sound judgment, and the ability to manage deadlines and competing priorities with professionalism and efficiency.

Job Requirements:
  • Independently manage a high-volume caseload of complex litigation matters across all phases, including pleadings, discovery, pre-trial, trial, and appeal
  • Serve as lead counsel in hearings, mediations, depositions, and trials
  • Evaluate legal exposure and develop strategic, risk-based litigation plans in alignment with client objectives and firm leadership
  • Draft and argue substantive motions, including motions to dismiss and motions for summary judgment
  • Conduct thorough legal research and draft pleadings, memoranda, discovery responses, and motion practice
  • Oversee all aspects of written and oral discovery, including managing depositions, expert discovery, subpoenas, and resolving discovery disputes
  • Prepare clients and witnesses for depositions, mediations, and trial testimony
  • Provide clear, strategic legal counsel to clients regarding case status, exposure, and litigation options
  • Respond promptly and professionally to client and investor escalations and inquiries
  • Participate in audits and respond to client due diligence questionnaires as required
  • Conduct legal analysis and provide recommendations across a broad range of issues, including:
    • Title curative, foreclosure, collections, replevin, bankruptcy, and evictions
    • State and federal regulatory compliance (RESPA, TILA, FDCPA, UDAAP, CFPB, SCRA)
    • Corporate governance, vendor and client contracts, data privacy, and borrower communications
  • Provide advisory opinions to support regulatory changes, including updates to processes, policies, and legal templates
  • Monitor litigation involving Prestige Default Services and respond to subpoenas, discovery, and regulatory/government inquiries
  • Review and approve legal work produced by junior attorneys and staff
  • Mentor and support junior team members, providing guidance on case strategy and legal writing
  • Collaborate cross-functionally with internal departments (bankruptcy, eviction, foreclosure, compliance, etc.) to align legal strategy and ensure efficiency
  • Track deadlines and maintain accurate documentation in the firm’s case management and calendaring systems
  • Contribute to the ongoing improvement of internal processes and litigation workflows
  • Remain current on changes in local, state, and federal laws, court rules, and industry trends that impact the firm’s practice areas
  • Work may be assigned across multiple practice areas, including but not limited to:
