Overview The Claims Adjuster provides legal civil liability analysis and determines disposition of cases brought against the City of Corpus Christi. This position will conduct investigations of claims to determine Citys liability in accordance with the Texas Tort Claims Act. The incumbent has the authority to accept or deny liability mitigate losses negotiate settlements and enter agreements. They will manage liability cases and financial case reserves and budget expenditures. The Claims Adjuster will research the law and determine applicability. They will also communicate liability issues regarding City operations and activities plan of action resolutions with City Manager Directors Managers Staff third parties claimants. Responsibilities · Research data analyzes legal issues & determines law applicability by reviewing State and Federal statues regulations ordinances case law law reviews · Advocates & negotiates by representing the city in civil pre-litigation matters reviews prepares correspondence settlement & releases. · Tracks liability cases assess risk assessment values create budget reserves & expenses · Reviews cost containments authorizes payments collects funding allocates recoveries to appropriate departmental accounts. Set & maintain budget reserves & make adjustments accordingly · Acts independently in evaluating claim exposures & making liability assessments · Provides directions to claimants and City staff to resolve problems & issues pertaining to operation & activities · Makes decisions regarding liability represents the City in civil matters · Advocates and negotiates by representing the City in legal matters · Practices principles of claims investigation litigation management adjustment documentation & evaluation of cases · Determines information needed to proceed with a legal matter · Obtains relevant documents determine potential witnesses review and apply appropriate claims adjusting remedies · Identifies liabilities and exposures take actions to eliminate future losses · Provides direction to Managers and Supervisors on appropriate actions concerning City operations & activities plan of action resolutions regards to liability issues · Meets planning discussions investigations strategies training & loss prevention efforts to mitigate future losses · Tracks cases via risk management information systems reviewed & updated accordingly tracking financial expenditures and financial reserves · Sets and monitor financial reserves process bills arrange rentals hire outside contractors · Make agreements with medical providers repairs are arranged inspections are planned finances are managed · Evaluations of losses Cost containments Medical Peer Reviews Legal Strategies · Meets with employees Managers Directors Litigation Attorneys City Manager regarding review of losses and strategies Position Type and Typical Hours of Work · Exempt - Full-Time- Monday-Friday 800am-500pm · Must be available to work additional hours as needed · Flexibility to work evenings weekends and holidays is a schedule requirement · In the event of an emergency employees are required to work to provide for the safety and well-being of the public including the delivery and restoration of vital services The above statements are intended to describe the general nature and level of work being performed by individuals assigned to this job.
