Position Summary/Objective

TBO Bank is seeking a dynamic, self-motivated and knowledgeable compliance professional to join our team.  Under general supervision, this role will perform a broad range of functions related to the bank’s Compliance Management System while following established policies and procedures and must maintain knowledge of the rules and regulations governing the bank.  The main purpose of this role is to provide advice, analysis, and reporting with respect to implementation of and compliance with applicable rules and regulations tied to banking partnership activities.  This role will be responsible for developing, implementing, and maintaining comprehensive compliance programs that support our fintech partnership operations.   

The ideal candidate will possess a strong understanding of consumer financial protection laws, as well as sophisticated knowledge of third-party risk management regulatory expectations and industry standards, and fintech business models.  This role is execution-focused and will work cross-functionally with operations, product, servicing, vendor management, marketing, and leadership teams to support ongoing compliance governance activities, and that banking partners operate with regulatory parameters.

ESSENTIAL FUNCTIONS

Regulatory & Bank Oversight

  1. Ensure the bank's operations comply with federal and state banking regulations, including but not limited to ECOA (Regulation B), EFTA (Regulation E), EFAA (Regulation CC), FCRA (Regulation V), TILA (Regulation Z), TISA (Regulation DD), FDCPA (Regulation F) UDAAP, consumer privacy, and third-party risk management expectations.
  2. Provide various duties as assigned to implement and carryout the bank’s compliance management system, including complaint management, tracking, reporting and auditing.
  3. Stay current on federal and state regulations and assist bank leadership in adapting and evolving bank operations to ensure compliance in an ever-changing regulatory environment.
  4. Conduct regulatory research and assist with interpretation of consumer financial protection requirements applicable to digital lending operations.
  5. Align goals with compliance department objectives and bank strategy.

Banking Partner Diligence & Oversight

Collaboration & Governance

  1. Provide direction and thought leadership on banking partner compliance matters, including regulatory interpretation and emerging requirements.
  2. Serve as the subject matter expert on banking partner compliance, advising Compliance management on regulatory risks and opportunities.
  3. Maintain the bank's banking partner compliance framework, policies, and procedures in alignment with regulatory guidance.
  4. Collaborate with business development teams to structure compliant partnership arrangements.

Individual Contributor Responsibilities

  1. Conduct pre- and post-launch compliance reviews of prospective banking partners, including compliance program assessments and evaluation of compliance risks.
  2. Review and approve banking partner disclosures, marketing materials, and customer-facing documentation for regulatory compliance.
  3. Perform ongoing monitoring and testing of banking partner compliance with contractual obligations and regulatory requirements.
  4. Prepare compliance reports and presentations for internal stakeholders, board sub-committees, and regulatory examiners.
  5. Investigate and resolve compliance issues, working with bank partners to implement corrective actions.
  6. Maintain comprehensive documentation of compliance activities, risk assessments, and monitoring results.
  7. Manage consumer complaint processes, including root cause analysis, trend identification, and corrective action oversight.
  8. Provide compliance advisory services to bank partners, including guidance on regulatory requirements and control expectations.

Risk Assessment & Monitoring

  1. Assist with compliance risk assessments in the areas impacting bank partnerships. 
  2. Create and maintain control performance, Key Risk Indicators (KRIs), and Key Performance Indicators (KPIs) for Compliance management. 
  3. Review bank partner operational processes to ensure an alignment with policies and procedures and bank standards/expectations.
  4. Assist leadership in execution of issue management, including documentation of escalations, action plans and remediations.

Audit & Exam Management

  1. Serve as liaison for internal and external audits and regulatory exams in relevant areas.
  2. Coordinate document requests, interviews, and response drafting.

Experience and Qualifications

  1. Prior experience working in financial services consumer compliance, with emphasis on fintech lending and third-party oversight (BaaS experience).
  2. Industry certification (CRCM, CERP, CAMS, etc.) preferred, or a willingness to obtain.
  3. Bachelor’s degree in business, Law, Finance, or related field preferred.
  4. Experience with third-party risk, operational risk, and/or banking products risk.
  5. Proficient in Excel (joining data-sets and reporting).
  6. Excellent leadership, communication, and organizational skills.
  7. Ability to manage competing priorities in a fast-paced, regulated environment.
  8. Strong analytical and data interpretation skills; ability to identify patterns and root causes in complex environments; ability to self-start.

Physical Requirements**

  1. Ability to sit or stand for extended periods while working at a desk or computer.
  2. Must be able to use a computer and other office equipment (e.g., phone, printer).
  3. Ability to communicate effectively in person, via phone, and through written correspondence.
  4. Ability to concentrate and focus on tasks for extended periods in a fast-paced environment.
