Summary of Responsibilities – Civil Litigation Attorney
The Civil Litigation Attorney will be responsible for handling a diverse caseload of civil and real estate-related litigation matters from inception through resolution. Responsibilities will include:
Independently manage civil litigation matters through all phases of litigation, including pre-suit investigation, pleadings, discovery, motion practice, settlement, trial preparation, and trial.
Draft and review pleadings, motions, affirmations, affidavits, discovery demands and responses, subpoenas, settlement agreements, and other litigation documents.
Conduct legal research and prepare persuasive legal memoranda, briefs, and written arguments.
Appear regularly in New York State Supreme Court and other state and local courts for conferences, hearings, oral arguments, and trials.
Take and defend depositions and prepare clients and witnesses for depositions, hearings, and trial.
Develop litigation strategies designed to achieve practical, cost-effective results consistent with each client's objectives.
Handle matters involving real estate and property disputes, breach of contract, commercial disputes, landlord-tenant related litigation, injunctions, declaratory judgment actions, and other general civil litigation matters.
Communicate directly with clients regarding case strategy, developments, risks, settlement opportunities, and anticipated costs.
Negotiate with opposing counsel and participate in settlement conferences, mediations, and other alternative dispute resolution proceedings.
Manage discovery, including document production, electronically stored information, interrogatories, notices to admit, depositions, and third-party discovery.
Maintain responsibility for court deadlines, discovery schedules, appearances, and other case-management requirements.
Work collaboratively with the firm's partners, associates, paralegals, and support staff while maintaining primary responsibility for assigned matters.
Assist in evaluating new matters, potential claims and defenses, and litigation strategy during client consultations.
Maintain organized and complete case files and contemporaneously record billable time in accordance with firm procedures.
Provide clients with responsive, professional, and practical advice, with an emphasis on resolving disputes efficiently while being fully prepared to litigate matters when necessary.
The ideal candidate will be a confident and practical litigator who is comfortable taking ownership of cases, appearing in court, dealing directly with clients and opposing counsel, and moving matters forward without the need for constant supervision.
Civil Litigation Attorney — Responsibilities
Assist with and ultimately manage a diverse caseload of civil litigation matters from inception through resolution.

Handle all aspects of discovery, including document demands and responses, interrogatories, notices to admit, subpoenas, and document review.
Prepare for, attend, and, as experience develops, take and defend depositions.
Interview and prepare clients and witnesses for depositions, hearings, and trials.
Participate in settlement negotiations, court conferences, mediations, and other dispute-resolution proceedings.
Assist with and ultimately take responsibility for trial preparation and trials, including preparation of witnesses, exhibits, motions in limine, and trial materials.
Handle matters involving real estate and property disputes, breach of contract, commercial disputes, landlord-tenant litigation, injunctions, declaratory judgment actions, and other general civil litigation matters.
Communicate directly with clients regarding case developments, litigation strategy, deadlines, settlement opportunities, and next steps.
Maintain regular communication with opposing counsel, courts, experts, witnesses, and other professionals involved in assigned matters.
Manage court deadlines, discovery schedules, appearances, and internal case-management requirements.
Review and analyze contracts, leases, correspondence, property records, financial records, and other documents relevant to litigation.
Work closely with the firm's partners and senior attorneys while progressively assuming greater responsibility and independence as skills and experience develop.
Collaborate with paralegals and support staff to efficiently move cases forward.
Maintain accurate case files and contemporaneous billing records in accordance with firm procedures.
Participate in client consultations and assist in evaluating potential new litigation matters.
Provide responsive, professional, and practical client service consistent with the standards of James G. Dibbini & Associates, P.C.

Qualifications & Skills
Admission to the New York State Bar and in good standing; newly admitted attorneys and candidates with limited litigation experience are encouraged to apply.
Prior civil litigation experience is preferred but not required. The firm is willing to provide training, mentoring, and hands-on experience to a motivated candidate with strong potential.
Strong legal research, analytical, and written advocacy skills.
Working knowledge of New York civil practice and procedure, or a demonstrated ability and willingness to quickly develop proficiency in the CPLR and New York court practice.
Excellent written and verbal communication skills.
Strong attention to detail and the ability to produce accurate, professional work product.
Highly organized and capable of managing multiple assignments, deadlines, and priorities.
Confidence and professionalism in dealing with clients, opposing counsel, court personnel, and other attorneys.
Strong work ethic, initiative, reliability, and a willingness to take ownership of assignments and cases as experience develops.
Ability to accept feedback and direction and a genuine desire to learn and develop as a civil litigator.
Interest in developing courtroom, deposition, negotiation, motion practice, and trial skills.
Ability to work collaboratively with associates, paralegals, and support staff.
Sound judgment, professionalism, and a commitment to providing excellent client service.
Experience or demonstrated interest in real estate litigation, commercial disputes, contract actions, property disputes, and landlord-tenant litigation is a plus.
Familiarity with NYSCEF, Microsoft Office, legal research platforms, and law firm case-management systems is helpful but not required.
Judicial clerkship, law journal, moot court, trial advocacy, clinic, internship, or other meaningful litigation-related experience will be considered favorably for candidates with limited post-admission experience.
Portable business is not required.
