Right-of-Way Specialist: Under the supervision of the Right-of-Way Supervisor, the Right-of-Way Specialist administers the Countys Development Standards and Regulations related to right-of-way dedications associated with development applications. Responsibilities include reviewing property boundaries and legal descriptions, negotiating assigned right-of-way matters, and providing guidance to County staff and the public regarding right-of-way dedications and easements.
The hiring range for a Right-of-Way Specialist = $61,805.39 - $89,617.82
Right-of-Way Agent: In addition to the responsibilities of the Right-of-Way Specialist, the Right-of-Way Agent performs a broad range of work involving the Countys existing and planned real property interests for roads and drainage. Responsibilities include researching and resolving property rights issues, negotiating property acquisitions, easements, and other agreements, administering right-of-way dedications associated with development applications, and providing property rights guidance to County staff and the public.

Examples of Duties for Success
Right-of-Way Specialist
- Research deeds, title records, and property information to prepare right-of-way, easement, and acquisition documents.
- Review development applications, subdivision plats, and building permits for compliance with County, state, and federal regulations and right-of-way requirements.
- Prepare and process right-of-way dedications, easements, deeds, agreements, and related documents for review by the Planning Commission and Board of County Commissioners.
- Secure deeds, easements, and agreements needed for County property interests associated with development and building permit applications.
- Review title reports and perform title research to verify ownership and existing property rights.
- Identify right-of-way impacts and determine right-of-way locations.
- Provide guidance to developers, property owners, contractors, engineers, attorneys, County staff, and the public regarding right-of-way requirements, development processes, and land use regulations.
- Assign addresses to newly created lots and other properties as required.
- Perform other related duties as assigned.
Right-of-Way Agent
In addition to the responsibilities of the Right-of-Way Specialist:
- Plan, coordinate, and negotiate the acquisition of real property interests for County capital improvement projects.
- Negotiate property acquisitions, easements, licenses, encroachment agreements, and other real property agreements.
- Prepare, execute, and record acquisition documents, including deeds, easements, agreements, legal descriptions, resolutions, contracts, reports, and related documentation.
- Coordinate acquisition activities with property owners, title companies, appraisers, attorneys, engineers, consultants, County staff, and other agencies.
- Present information regarding right-of-way and easement acquisitions to County departments, the public, the Planning Commission, the Board of County Commissioners, and external agencies.
- Review appraisals, property valuations, right-of-way plans, roadway plans, legal descriptions, maps, and related documents to ensure compliance with applicable requirements and project needs.
- Process payments related to property acquisitions and consultant contracts.
- Conduct field inspections to evaluate property acquisitions for transportation and drainage projects.
- Research historical property records to identify ownership interests.
- Provide testimony in legal proceedings related to right-of-way acquisitions when required.

Qualifications for Success
Right-of-Way Specialist
- Determine the status of existing rights-of-way and easement agreements.
- Prepare legal documents related to right-of-way conveyances and easements.
- Research property ownership, deeds, and legal descriptions using Clerk and Recorder records.
- Interpret title commitments, title policies, plats, maps, survey notes, legal descriptions, and engineering plans.
- Apply applicable federal, state, and local laws, regulations, policies, and procedures related to land development and right-of-way.
- Read and interpret legal descriptions in accordance with standard practices.
- Perform mathematical calculations related to right-of-way activities.
- Maintain accurate records and prepare clear written and oral communications.
- Use Microsoft Office and other standard business software.
- Establish and maintain effective working relationships with County staff, external partners, and the public.
Right-of-Way Agent
In addition to the knowledge and skills required of the Right-of-Way Specialist:
- Apply principles and practices of real estate transactions, property acquisition, appraisal, and title review.
- Prepare, review, and interpret deeds, easements, legal descriptions, agreements, resolutions, and other legal documents related to property acquisition.
- Interpret land surveys, subdivision plats, engineering plans, and right-of-way documents.
- Prepare acquisition documents and Board of County Commissioners materials related to real property transactions.
- Perform title searches, prepare waiver valuations, and review appraisal reports for compliance with applicable requirements.
- Apply the Uniform Relocation Assistance and Real Property Acquisition Policies Act (Uniform Relocation Act) and applicable federal, state, and local laws governing property acquisition.
- Apply civil engineering and land surveying principles to right-of-way acquisition activities.
- Use Microsoft Office, GIS applications, and workflow management software.
- Maintain accurate records and prepare clear written and oral communications.
- Establish and maintain effective working relationships with County staff, property owners, consultants, and external agencies.
More Qualifications for Success
Right-of-Way Specialist
Experience: One (1) year of right-of-way or closely related experience.
Education and Training:
- High school diploma or GED required.
- Supplemental training or coursework in real estate law, engineering, surveying, or a related field is preferred.
Right-of-Way Agent
Experience: Four (4) years of progressively responsible right-of-way or related experience, including property acquisition, title research, legal document preparation, real estate appraisal, engineering plan review, technical report writing, or similar work.
Education and Training::
- High school diploma or GED required.
- Supplemental training or coursework in real estate law, engineering, surveying, or a related field is preferred.
- A bachelors degree may substitute for up to four (4) years of the required experience on a year-for-year basis.
Certification:
- International Right of Way Association (IRWA) Right-of-Way Agent certification, or higher, is preferred at hire and may be required within 18 months of employment.
All Levels
Licenses: Possession of, or ability to obtain, a valid drivers license.
Background Check: Must successfully pass a criminal background check.
Other Requirements:
- Ability to travel throughout the County.
- Ability to work in a standard office environment.
- Ability to research property ownership and related records.
- Knowledge of the Public Land Survey System (PLSS) and land boundary principles.
