Supports the Chief Equal Opportunity & Title IX Officer in the oversight of the Office of Title IX & Equal Opportunity, at The University of Texas Rio Grande Valley by performing highly specialized non-routine fact-gathering and investigative functions primarily related to complaints by employees, students, and others protected under state or federal civil rights and anti-discrimination laws, which involve allegations of discrimination, sexual misconduct, or retaliation.

Description of Duties

  • Functions as the Acting Lead in the absence of the Chief Equal Opportunity & Title IX Officer with respect to oversight of the Office of Title IX & Equal Opportunity. Performs duties and responsibilities, as assigned, necessary for the effective accomplishment of the Office of Title IX & Equal Opportunity mission.
  • Makes recommendations to the Chief Equal Opportunity & Title IX Officer with regards to policy administration, violence prevention, and inclusive culture initiatives.
  • Assists the Chief Equal Opportunity & Title IX Officer in executing UTRGV's prompt, effective and equitable response to complaints of discrimination, sexual misconduct, and retaliation.
  • Develops, coordinates, organizes, conducts, and evaluates departmental and other University trainings, workshops and outreach programming related to equal opportunity, nondiscrimination, accessibility, and the prevention of sexual misconduct in compliance with policy, federal and state law, such as Title VII, Title IX, VAWA, and Clery for the UTRGV community.
  • Performs complex investigations involving allegations of discrimination, sexual misconduct or retaliation involving faculty, staff, or students.
  • Investigates complex cases, as needed, on behalf of other departments within the Institution as to alleged violations of policy.
  • Serves as the chief investigator for the Office of Title IX & Equal Opportunity.
  • Acts as subject matter expert with respect to recruitment, hiring and retention practices aimed at ensuring equal opportunity, which includes review of job applicant pools to ensure compliance with federal and state equal opportunity regulations.
  • Establishes and maintains external relationships meant to promote violence prevention.
  • Implements formal and informal resolution procedures in accordance with regulatory requirements and UTRGV policies and adheres to the established standards.
  • Conducts intakes, inquiries, and investigations of alleged violations of UTRGV policies, rules, and regulations regarding discriminatory behavior of Title VII, Title IX and/or Violence Against Women Act (VAWA).
  • Contacts, schedules and interviews complainants, respondents and witnesses and verifies information to determine findings based on policy standards.
  • Provides information regarding available campus and community resources, assigns interim measures to remedy complaints, and counsels as to appropriate reporting and wellness resources and services options.
  • Reviews and maintains evidence and documents for use in administrative investigations.
  • Evaluates and summarizes investigative findings.
  • Prepares investigation files, correspondence, and administrative.
  • Prepares and presents information related to investigative findings for review and consideration by various Campus Administrator(s) who are responsible for the implementation of disciplinary or corrective action.
  • Collaborates with appropriate Campus Administrator(s) to prepare cases for administrative hearings; presents testimony and evidence at applicable administrative hearings.
  • Reviews investigative techniques and recommends process improvement.
  • Collaborates with other university offices in the development and implementation of University initiatives regarding Title VII, Title IX, and VAWA and related administrative policies.
  • Recommends new policies and procedures for improvement of Title VII, Title IX and VAWA activities.
  • Gathers relevant documentation and maintains accurate, consistent, and detailed records on assigned cases.
  • Maintains and monitors data related to complaints and investigative activities and provides periodic reports as needed to inform best practices.
  • Performs other duties as assigned.

Required Education

Bachelor's degree from an accredited university.

Preferred Education

J.D. or other advanced degree.

Licenses/Certifications

None.

Required Experience

Five (5) years of progressively responsible experience in an investigative, legal, student conduct, human resources or related field, including knowledge, training, and/or experience conducting Title IX or EEO investigations. Knowledge of federal laws and other legal issues related to higher education.

Working Conditions

Needs to be able to successfully perform all required duties. Work is generally performed in an office or classroom environment. UTRGV is a distributed institution, which may require a regular presence at multiple locations throughout the Rio Grande Valley.

An investigative mindset and demeanor, including the ability to conduct difficult interviews regarding sensitive subject matter.
