Obtain necessary information from every possible source, from claimant's counsel to insureds, construction workers, first responders, other witnesses, and from experts such as engineers, consultants, and health care practitioners, to fully and accurately assess the causes and extent of each loss and to maximize opportunities to transfer the loss via rights of additional insured status and contractual indemnification from others. Use knowledge of construction and CGL insurance practices in the New York construction market, particularly as driven by risk transfer and avoidance strategies of insurers that are related to New York's Labor Law vicarious liability statutes, to successfully shift duty to defend and indemnify to downstream contractors and carriers.
